Ram Kinkar Shahi Memorial Foundation is a Section 8 Company incorporated under the Companies Act, 2013, established with the objective of promoting charitable and social welfare activities.
The Foundation aims to work in areas including education, health, sports, social welfare and other activities in furtherance of its charitable objectives as specified in its Memorandum of Association.
Donations received by the Foundation may be utilized for activities and programs undertaken in furtherance of its charitable objectives.
Depending upon the nature and purpose of the contribution, donations may support activities such as:
The Foundation accepts voluntary donations from individuals, organizations, institutions and other eligible donors, subject to applicable laws and regulations.
The Foundation reserves the right to refuse or return any donation that is inconsistent with its charitable objectives, applicable laws, regulatory requirements or ethical standards.

The Foundation may issue an official donation receipt against donations received, subject to receipt of sufficient donor and transaction details.
Donors may be requested to provide their name, contact details, address, transaction reference and other information reasonably required for accounting, record-keeping and statutory compliance.
Where a donation is received without adequate donor information, the Foundation may record the contribution as an unidentified or anonymous donation, as applicable under prevailing laws.
The Foundation's registration under the applicable provisions relating to 12AB and 80G of the Income-tax Act is currently under process / subject to approval.
Until the applicable approval under Section 80G is granted and becomes effective, donors should not claim any tax deduction under Section 80G merely on the basis of a donation receipt issued by the Foundation.
Once the Foundation receives the applicable 12AB and 80G approvals, the relevant registration details and applicable terms will be updated on the Foundation's website and donation receipts, as required.
Donations received by the Foundation shall be utilized for charitable purposes and activities in accordance with its Memorandum of Association, applicable laws and the terms, if any, attached to the donation.
The Foundation may use a reasonable portion of unrestricted donations for administrative, operational and program-related expenses necessary for carrying out its charitable activities.
Unless a donation is specifically accepted for a particular purpose, donations shall generally be treated as unrestricted contributions and may be utilized by the Foundation for any of its charitable objectives.
Donations given for a specific purpose shall be utilized in accordance with the terms communicated and accepted by the Foundation, subject to applicable laws.
A donation shall be treated as a corpus donation only when the donor has provided a clear and specific written direction that the contribution is intended to form part of the corpus of the Foundation and such acceptance is permitted under applicable laws.
Donations are generally voluntary and non-refundable once received and acknowledged by the Foundation.
However, in case of an erroneous transaction, duplicate payment, unauthorized transaction or other exceptional circumstances, the donor may contact the Foundation within a reasonable period with relevant transaction details.
Any refund request shall be reviewed on a case-by-case basis and processed subject to verification, applicable laws, banking/payment gateway rules and the Foundation's internal policies.
The Foundation respects the privacy of its donors. Donor information collected during the donation process may be used for issuing receipts, maintaining financial records, statutory compliance, communication and other legitimate administrative purposes.
The Foundation shall take reasonable measures to protect donor information and shall not knowingly sell or rent donor personal information to third parties.
The Foundation shall maintain appropriate records of donations received and their utilization in accordance with applicable accounting and statutory requirements.
The Foundation is committed to maintaining transparency and responsible financial management in the use of donated funds.
The Foundation reserves the right to amend or update this Donation Policy from time to time to reflect changes in applicable laws, regulations, operational requirements or organizational policies.
The updated version of this policy shall be published on the Foundation's website whenever appropriate.
